About freedom
My principal asset is to have been born from my parents.
The main source of distress for me is to have been born in Spain.
Here, as usual oftenwhere else, there is strong interest and pressure to hide certain details of the past.
It's a something sturding experience to see ( at least in the media ), that even today ( 2008 AC year ), common graves containing the remnants of people murdered along the war of Spain ( 1936-1939 ) are been searched and excavated. Too many people don't know even today where were buried their relatives or beloved ones. And there are instances that are strongly against such practices. They want keep the country under a selective amnesia.
In the everyday life, there is a very strong pressure over victims to make them forget what did they suffer and by whom.
This cannot be that way forever.
So, in the memory of my Parents, in respect of each and every victim under similar circumpstances, I've decided to begin to write a squetch of my life hoping it be useful for anyone anywhere anygoal.
The true make men free.
I have to expose then my true. An objective description of some capital events of my life.
So that, invoking the right to free speech, I declare that in my writings, either in the past, and in the future, I'll try to observe respect to others, comply with regulations and be in accordance with faits. Un bombero, un policía o un piloto, para poder serlo tienen que demostrar que están en sus cabales, en pleno uso de sus facultades mentales. Tienen que pasar pruebas psicotécnicas y de personalidad. Un juez, el encargado de decidir si alguien debe pasar 35 años en la cárcel, no. Tampoco va a ser evaluado durante sus años de ejercicio profesional.
Un bombero, un policía o un piloto, para poder serlo tienen que demostrar que están en sus cabales, en pleno uso de sus facultades mentales. Tienen que pasar pruebas psicotécnicas y de personalidad. Un juez, el encargado de decidir si alguien debe pasar 35 años en la cárcel, no. Tampoco va a ser evaluado durante sus años de ejercicio profesional. ¿Y si sufre depresiones severas, tiene un trastorno bipolar o esquizofrenia? El procedimiento para jubilar a los jueces por incapacidad es lento y complicado. La comisión disciplinaria del Consejo General del Poder Judicial, encargada de sancionar a los magistrados, acaba de alertar de una realidad conocida en la judicatura: hay jueces con graves problemas de salud mental que continúan en sus puestos de trabajo y toman decisiones sobre la vida de los ciudadanos.
El caso del juez de familia Fernando Ferrín Calamita, recientemente suspendido de su cargo y sancionado por denigrar a los homosexuales en sus resoluciones, ha puesto de nuevo sobre la mesa la necesidad de hacer normas específicas para afrontar este problema. Ferrín ha reconocido que sufre una "depresión reactiva en fase aguda" y que, al menos desde 1995, padece de "distimia", una alteración del estado anímico, y de "estrés laboral". Sus problemas de salud mental duran ya más de 12 años, pero sólo en 2007 el Tribunal Superior de Justicia de Murcia, decidió practicarle un examen médico para decidir sobre su jubilación por incapacidad. El procedimiento aún no ha concluido. La comisión disciplinaria del CGPJ elevó un informe al pleno en febrero en el que pedía que se trataran estos problemas. Este órgano, al que llegan las quejas y las denuncias, reconocía que había "constatado la enfermedad psíquica de determinados magistrados que siguen realizando sus funciones de manera irregular". Esta situación, según el informe, supone "un perjuicio para el correcto ejercicio de la función jurisdiccional y para la efectiva tutela judicial de los ciudadanos".
El pleno del CGPJ rechazó adoptar medidas al respecto alegando que, planteado así, el asunto produciría una alarma social injustificada. Y el portavoz, vocal conservador Enrique López, negó que hubiera una preocupación especial por estos casos. Sin embargo, la comisión disciplinaria del Poder Judicial no es la única alarmada. Asociaciones como la progresista Jueces para la Democracia también piden que se articulen medios para que los jueces con graves anomalías no puedan seguir actuando. Y un informe de octubre de 2006 del Poder Judicial reconocía que había en esos momentos unos 30 jueces con "padecimientos psíquicos".
"Que hay jueces que no deberían trabajar por problemas psíquicos lo sabemos todos en la carrera", señala Jaime Tapia, portavoz de Jueces para la Democracia. "Formalmente trabajan, pero no ponen sentencias o las que ponen tienen carencias importantes". Tapia afirma que sería necesario un control psicológico previo al acceso a la judicatura, como el que existe en otros países. "Y después, el servicio de inspección del Consejo del Poder Judicial tiene que actuar con celeridad en cuanto detecte algún problema y adoptar medidas cautelares. Estos casos en seguida se saben. Pero a veces el propio Consejo es cómplice y espera a que lleguen denuncias formales ante situaciones que son sobradamente conocidas. Cuando se toma una decisión, el juzgado suele estar absolutamente colapsado y las decisiones del juez han afectado ya a muchos ciudadanos. Esto no puede ser. Ante todo, debe primar siempre el servicio público que es la jurisdicción", concluye.
¿Cuál es el problema? ¿Por qué se deja durante años actuar a un juez claramente incapaz de ejercer su función? Una de las razones principales parece ser económica. Los jueces se oponen a ser incapacitados porque la reducción del sueldo es muy notable. "Casi el 60% del salario son complementos y eso no se tiene en cuenta a la hora de la pensión, por lo que los jueces jubilados pasan a cobrar menos de la mitad", explica Lorenzo del Río, portavoz de la asociación moderada Francisco de Vitoria. "Por eso, a diferencia de otras profesiones, los miembros de la carrera judicial rechazan sistemáticamente la jubilación ante los tribunales médicos", añade el vocal progresista del Poder Judicial, Javier Martínez Lázaro.
Otro problema es que no hay reglas especiales para jueces y magistrados, que están sujetos a las mismas normas que el resto de funcionarios. "No tienen unas causas de incapacidad específicas distintas de las de otros funcionarios", explica Martínez Lázaro.
Pero el trabajo que desempeñan es muy diferente. Hay patologías que en otras profesiones no incapacitarían a la persona pero que impiden ejercer la función jurisdiccional. El trabajo de un juez se basa en la argumentación, en la razón, y cuando están en órganos unipersonales la responsabilidad total y absoluta recae sobre ellos. Pero los médicos que evalúan la incapacidad no son siempre conscientes de este hecho diferencial.
"En la judicatura no existe una segunda fila donde destinar a jueces con patologías que impiden tomar decisiones trascendentes pero no inhabilitan para un trabajo normal", señala Martínez Lázaro. "Un fiscal, por ejemplo, puede dejar de acudir a juicios y dedicarse únicamente a hacer informes, pero los jueces y magistrados toman decisiones importantes todos los días.
"Hay jueces que tienen problemas para tomar decisiones, son dubitativos y no ponen sentencias", señala Lorenzo del Río, de la Francisco de Vitoria. "Podrían, a lo mejor, hacer algún trabajo de apoyo, pero no estar al frente de un juzgado. Quizá para estos casos u otros que no sean muy graves podría hablarse de una incapacidad parcial y destinos de segunda. Es verdad que hay una laguna en la regulación que hay que definir".
Por todas estas razones, el Consejo General del Poder Judicial solicitó al Ministerio de Justicia hace unos años que se articulara un sistema propio para estos casos controlado por el gobierno de los jueces en lugar de por la Seguridad Social. Ese nuevo sistema incluiría unas causas de incapacidad propias para magistrados, unidades evaluadoras específicas y establecería un período transitorio de seis años durante el cual el juez tendría derecho a cobrar el 80% de su sueldo. Así, el perjuicio económico no sería tan importante y los jueces se opondrían menos a dejar sus cargos cuando no pueden ejercerlos. Esta propuesta, que exigiría una reforma de la Ley Orgánica del Poder Judicial, no ha sido escuchada por el momento.
Mientras tanto, no es frecuente, pero sí posible, que los ciudadanos se encuentren a un juez depresivo, con ansiedad, que argumenta de forma absurda sus sentencias o que tarda tres años en ponerlas. Son casos contados, pero con una enorme trascendencia. Porque cada juez ejerce, por sí solo y de forma independiente, uno de los tres poderes del Estado. El de impartir justicia.

The mania to apparent otherwise than the inner reality
I was fortunate with my loved parents. By the opposite, Spain has been my main ennemy. Spain is a very dangerous country for honest and decent people. It has accumulated in its 5 last centuries of degrading an enormous amount of lack of sensibility and brutality.
An example is the terrible slaughtering in the Arenas of more than 10.000 bulls every Summer.
A rather common trace of Spaniards is their trend to apparent what they aren't really.
I remembered this when reading this afternoon about Juan Luis Rubio, of the Association of Separated Fathers of Madrid. He claims for the support they give to harassed fathers in separation / divorce lawsuits, but when I first suffer from strong Judiciary harassement, by past year 1994, he refused to help, and even didn't answer my call for support, being undefended.
As a popular proverb states, Spaniards prefer to be head of Mouse rather than tail of Lyon.

To readers. Some things to do, and feedback
aboard. And I see how most Spaniards even doesn't answer your mail. Anyway no help was
received. And you may imagine what can I do in front of the whole State and its Corporations.
Therefore a re-planning task was due.
All this is linked with the fact that the whole country ( maybe with the exceptions of Catalonia and the Basque Country ) is a fictional one, that even today hasn't assumed the fact that its long decline from the very top to almost dissolution was due to its unability to positive and creative way to assume and overcome the past. In fact, psychologically, Spain is more linked to Near East that to Center Europe. His case hasn't been as dramatic as the Arab countries, but it has elements in common. In Spain never has been a real Revolution.
Religion, or rather, a certain way to interpret it, the Roman Catolic one, was a capital element of its superstructure. To summarize, within that psychological umbrella, everything is permited, provided that in the 'last instant' you became converted and ask your sins be perdonned. This is an important source of corruption. Another key element is the imaginative idealism. This consist in the position of which not liking his present, but not having capabilities, resolution or committement to change things, build a fictional scenery, and settle himself in it, with time, this is his real environment. Confusing delirant ideas with reality. This environment trend to be closed. Spain has been, and in part still is, a rather closed country. Hermetic country.
Individuals, in their common life, show traces of what described. So, cooperation is rather difficult. Spaniards act under the direction of a leader. Sometimes, as reaction, they showed an anarquic trend. This psycho-sociological environment is dangerous at all levels. It's difficult to escape from it. It acts as a 'black hole'. What you fight trend to link you.
However, I think all that is not good for Health, Love, Self Achievement and Happyness. And I firmly beleive that all human beings have to fight for their rights, and fight against anything/anyone who rape / prevent them.
What to do ?
Is not possible fix all problems a a time.
Problems lasting centuries cannot be fixed in days.
But is necessary give steps in the right direction.
1.- Create a true democratic culture from Primary School onwards.
Fostering lectures on human values, solidarity, self achievement.
Developping experimental classes to teach/learn nature. Caring nature. Planting trees. Cleaning lands. Traveling.
2.- Total reform of Judiciary.
Free access of citizens to Courts.
Creation of a commission to simplify all Laws, Regulations and Proceedings of the State.
Set up instruments to claim for effective responsibility of all Civil Servants of the State.
3.- Reform of the political parties, to convert them in truly democratic bodies. Open lists in
elections. Elaborate a reglament of duties of Members of Parliament towards theirs electors
( right now, M.P.'s may even doesn't answer a letter sent from you, neither receive you in
their office ) . Really, the actual M.P.'s are very like those in the Franco' times towards
citizens. Try to speak with them is like try to speak with God. And, if by any exceptional
case ( 'amity', any kind of relationship ), a M.P. grant you a rendez-vous, then the real
interest for your problems is null. In Spain, distance between 'theoretical citizens' and
high Civil Servants or Deputees is infinite. If you go once to the Parliament House, you lost
the envies to repeat.
I think that a way to begin reverse these things is set up public Platforms to debate,
disseminate panflets, and set up agreed procedures to act/react collectively. This is
really affordable. This is a way that implements Civic Active Resistence.
The Parliament Square, in Madrid, is a suitable place for a weekly democratic kermesse.

That is how you make Peace
The war in Lebanon has ended and the fast rhythm of life might make us forget what happened; yet the trauma and the lack of communication with the other side prepetuates the hostility in the Middle East.
During the happiness workshops of the Association for Prosperity and Security in the Middle East, which are based on The Way to Happiness® booklet, children and adults get the opportunity to unload what's on their hearts.
During one of those happiness workshops the children arrived to the conclusion that they can influence on their own lives and on the happiness of others. They also understood from the discussion that it is possible that the are children in Lebanon exactly like them that suffered – just like them - from shelling while in war.
There was an immediate decision to do something about that, and each kid took a paper and wrote on it what he would say if he met a Lebanese kid that set in a shelter during the bombs (see the attached picture). Here's what they wrote:

In the 70s it took several years to educate the public that there are protected flowers which are forbidden to pick. We believe that activities like those received by pupils of all grades in both countries will raise a generation that will be aware to the fact that across the border live… people! People who actually don't want to bomb anyone and do not like to be bombed.
It is a fact that as for this moment there's one team who actually take effective action about that –
"The Way to Happiness" team.

9th Mars 2008 Gen.Elections: One vote lost
I'm not interested about aby particular political party. MP lists are closed. So, you have to vote the complete list; no add, no withdraw.
I sent a fax to the Consulate of Spain in Marseille... telling them my wish to vote, my site of registration ( commune ), and address. No answer so far. I sent a mail to the Socialist Party, in Madrid, in similar terms. No answer so far. Maybe they think they have votes in excess ( excess of confiance normally don't give good results ).
Years before, after I had to leave my house for the exclusive enjoy of my ex-wife and their children, somehow I was withdraw of the census of Spain.
The system do know what to do with electors.
Sometimes, deads voted in Spain. Sometimes have been 'problems' with the vote of emigrants.
I beleive it is a bad affair to despise even a single vote. You don't know a priori if even a single vote may give a deputy to a party or not.
Besides, this way to act is a meprise to democracy.
Today 26th Feb., I received a letter from Consulate of Marseille telling me that due date to apply
to vote was late 9th Feb.

Pending to fix
But the state never will renounce at that resort of pow er and control. The only way is by force.
Here is a list of pending affairs, who need volontiers to proceed with them.

irrestricted access to Court. We must end with a situation in wich access to Court is kidnapped
by Lawyers and Procurators. Many people accept injustices and damage by not go to Courts,
prefering that to hire Lawyer and Procurator, who commands high bills for their 'work'.
This monopoly of Justice has to end.

don't serve the citizens' interests. Let you think, to give an idea, that most deputees even
doesn't answer letters send to them. Neither gave rendez vous to electors. I don't understand
how citizens accept that situation. A shame.

It's a must to make all the Spanish Administration in situation to serve the people, who is who

Spain and Kosovo
Why?
I don't know what image have foreign observers about this country. Even a considerable part of their inhabitants. Because, and it may appear extrange, but Spain has even today big influence from the past, still not analyzed objectively, hence not assumed neither surpassed, who when confronted with their Europeans neighbours gave origin to a complex of inferiority, and a tic of rigidity, manifested in many aspects of their behaviour in scene. Not a land for diplomacy.
Spaniards trend to act with severity towards the weaks, and rather cowardize to strong ones. The State is weak, dominated by a coalition of lobbies, in unstable equilibrium.
As there is no democracy neither Justice, grievance towards middle and working class is high, and a substantial part of 'citizens' ( who are such only in paper ) are ressentled towards the State.
This internal weakness, could dismembre the State at its due time.
The lack of Justice and Democracy will be the originating factors.
Nevertheless, the nomenklatura will say otherwise.
Always is the same.
Plus ça change, plus c'est la même chose.
The liar may lie. Even to himself. But not always. And in the very deep, some unrest is neverending rolling.
The nomenklatura of Spain has motifs to be concerned about Kosovo.
